Free car park, £100 charges: Why shoppers say parking at Waterside is catching people out

A car park most shoppers assume is free has become the source of growing anger and confusion in Ilkeston.

Over the past month, Ilkeston News has been contacted by a steady stream of residents who say they have received parking charge notices of up to £100 after using the car park at Waterside Retail Park.

What is striking is not just the number of complaints, but the range of reasons being given – and the fact that many drivers say they were using businesses on the site and believed they had parked perfectly reasonably.

A free car park – with costly consequences

Waterside Retail Park does not operate a pay-and-display system. There are no ticket machines and no requirement to pay to park.

Yet shoppers report receiving Parking Charge Notices days later in the post, typically demanding £60 if paid quickly, rising to £100 if not.

These are not council-issued fines. The car park is managed by private operator Premier Park, meaning the charges are issued under civil contract law rather than traffic enforcement legislation.

For many motorists, this distinction only becomes clear after the letter arrives.

What people are being charged for

Residents contacting Ilkeston News say the charges are not limited to one type of alleged breach.

Reasons given on notices and appeal rejections include:

  • parking slightly outside bay markings
  • parking across two bays
  • “parking and leaving the site”, even when drivers say they were using shops on the retail park
  • alleged failure to comply with terms shown on signage

Several motorists say the photographic “evidence” supplied does not clearly show wrongdoing, while others say their appeals were rejected despite explanations and supporting details.

Visibility, markings and conditions

A recurring theme in complaints is the condition of the car park itself.

Shoppers describe:

  • worn or faded bay markings
  • poor visibility in darkness or bad weather
  • signage that is difficult to read, particularly at night

Some say they parked during periods of heavy rain or low light, believing they were correctly positioned, only to later receive a charge based on images taken after the event.

For many, the issue is not whether rules exist – but whether the site is maintained to a standard that makes strict enforcement fair or reasonable.

A familiar operator, familiar concerns

Premier Park is a well-known private parking operator nationally and has attracted a high volume of consumer complaints across the UK.

Motoring forums, consumer review sites and legal advice pages are filled with accounts from drivers who believe they were charged unfairly, penalised for minor technicalities, or had appeals rejected despite mitigating circumstances.

Against that backdrop, local shoppers say the situation at Waterside feels less like an isolated issue and more like a known pattern arriving locally.

Why this has struck such a nerve

Waterside Retail Park is not a niche or specialist site. It is used daily by:

  • families doing food shops
  • older residents
  • people making short, routine visits

For many, it has always been seen as straightforward, no-stress parking.

That is why the arrival of three-figure charges from a free car park has come as such a shock – and why anger has been building over several weeks rather than fading away.

One resident told Ilkeston News:
“If this many people are being caught out in the same place, the problem can’t just be the drivers.”

What shoppers are now doing

As word spreads, some residents say they are actively avoiding the car park, while others report parking with extreme caution, taking photographs of their vehicle and surroundings before leaving.

That behaviour, shoppers argue, should not be necessary in a free retail park used by the public every day.

Questions that remain unanswered

At this stage, Ilkeston News is not making any judgement on the validity of individual parking charges.

However, the volume and consistency of reports raise legitimate questions:

  • Are terms and conditions being communicated clearly enough?
  • Is the car park infrastructure being maintained to support strict enforcement?
  • Is enforcement proportionate in a free, everyday shopping car park?

These are questions many residents believe now deserve clear answers.
